Fatal Pedestrian Accidents in Alabama
A recent study found that Alabama was one of the deadliest states in the entire country for pedestrians. In fact, the state came in at number nine overall for having one of the highest fatality rates for pedestrians with a rate of 0.54, which is 28.6% higher than the national average.
In Alabama, we see many pedestrians lose their lives in accidents that are caused by driver negligence. Some of the most common causes of pedestrian crashes in our state include:
- Distracted driving
- Speeding and engaging in other reckless driving actions
- Failing to see pedestrians
- Failing to yield the right of way to pedestrians
- Driving while under the influence of drugs or alcohol
- Drowsy driving
- Inattentive pedestrians
The state of Alabama follows modified comparative fault laws. This means that a defendant must be more than 51% responsible for the accident taking place. In many cases, drivers will try to convince the courts that the pedestrian is solely responsible for their crash or holds the majority of the responsibility. This can make it extremely challenging for families to recover after enduring the loss of a loved one.
In order to ensure you have the best chances of getting justice after your accident, it is best that you seek the assistance of a wrongful death lawyer in Mobile.
